Terms of Service

These are the terms for nearhold.com and the Nearhold service, operated by Easy Beach LLC (“Nearhold,” “we,” “us”). We've written them in plain English on purpose. By joining the waitlist, placing a founding deposit, subscribing, or using the service, you agree to them. If you don't agree, please don't use Nearhold.

You must be 18 or older and located in the United States to place a deposit or subscribe. Our Privacy Policy explains what we collect and why — it's part of the deal.

What Nearhold is

Nearhold provides situational awareness from publicly available first-responder dispatch radio. Where the service is live, it listens to public dispatch audio and sends you notifications about activity near an address you choose, with the original audio linked so you can hear it yourself.

Nearhold launches county by county. Where it isn't live yet, the site offers a coverage check, a free waitlist, and an optional refundable founding deposit. Coverage shown by the checker reflects our best current information about public channels, not a promise.

What Nearhold is not

This is the most important section on this page, so we'll be blunt:

  • Nearhold is not a medical alert or personal emergency response system.It is not a medical device, does not monitor anyone's health, body, or home, and is not a substitute for medical alert services, fall detection, or in-home monitoring.
  • Nearhold is not an emergency service and cannot send help. We have no connection to 911, dispatchers, or responders. Nearhold only listens to what is publicly broadcast. In an emergency, always call 911.
  • Nearhold is not a life-safety product.Do not rely on it to protect anyone's life, health, or property, or to learn about emergencies in time to act on them.

About alerts and coverage — no guarantees

  • Alerts come from unconfirmed public radio traffic. Dispatch calls are real-time and unverified. They get updated, downgraded, and canceled as responders arrive. Summaries and matches are AI-generated from that audio and can be wrong, incomplete, delayed, or missing entirely.
  • We do not guarantee that any event will be caught. A fire, EMS, or police dispatch to or near an address you monitor may not produce an alert, for many reasons: encrypted or offline channels, radio conditions, address ambiguity, processing errors, or gaps in coverage. Absence of an alert never means nothing happened.
  • Coverage varies and changes. Public dispatch channels appear, disappear, and get encrypted without notice. A county that is covered today may not be tomorrow.
  • No uptime commitment. The service may be interrupted, degraded, or unavailable at any time, with or without notice.
  • About speed.Where our site or emails describe timing — “in seconds,” “under a minute” — that describes how the service is built to perform when everything works. It is not a promise that any alert will arrive in that time, or at all. This section always controls.

Your agreement, no one else's

These terms are between you and us. No one else — including the person whose address you monitor — gets rights under them. You agree to tell anyone who relies on information you get from Nearhold about the limits described above.

You agree not to rely on Nearhold as your way of learning about emergencies, and to keep whatever emergency arrangements — medical alert devices, check-in routines, neighbors, family calls — you would have without it.

If someone else brings a claim against us because of how you used Nearhold or shared its alerts, you agree to cover our reasonable costs from that claim.

The founding deposit

  • The founding deposit is $1, and it is refundable: email hello@nearhold.com any time before your county launches and we'll refund it, no questions asked. If we haven't launched service in your county within 6 months of your deposit, we refund it automatically.
  • When your county goes live, your deposit counts as your entire first month of service, and your rate is locked at $5 per month for as long as you keep a continuous subscription. Canceling and resubscribing later means the founding rate is gone — that's what “founding” means.
  • Billing never starts on its own.When your county goes live, we'll email you (more than once), and monthly billing begins only if you confirm through a new checkout. We do not store your card from the deposit. If you'd rather not subscribe, tell us and we'll refund your dollar. And if we haven't heard from you within 60 daysof our first launch email, we'll refund your dollar and release your founding spot — we don't keep money for a service you never started.
  • The deposit does not guarantee that Nearhold will launch in your county. It moves your county up our build order and locks your founding rate. If we never launch there, you get your dollar back.

Billing and cancellation

Subscriptions are $5 per month for founding families (standard pricing may differ), billed monthly through Stripe, and renew each month until you cancel. Canceling is as easy as subscribing — one click in your account or one email to hello@nearhold.com. When you cancel, service runs to the end of the period you've paid for, and nothing renews after that.

You're responsible for keeping your account email current — it's how we reach you about coverage changes and billing.

Your responsibilities

  • Give us accurate information, and only monitor addresses you have a legitimate personal connection to, such as a family member's home. Don't use Nearhold to surveil, harass, or stalk anyone.
  • Don't misuse the service: no reselling alert data, no scraping, no attempts to break or overload the system. We can suspend an account while we investigate suspected misuse, and terminate it for confirmed misuse. If we terminate you before your county launches, we still refund your deposit; subscription fees for service already delivered aren't refunded.

Disclaimer of warranties

NEARHOLD IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT ALERTS WILL BE ACCURATE, TIMELY, COMPLETE, OR DELIVERED AT ALL, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. Some jurisdictions don't allow certain warranty exclusions, so parts of this may not apply to you.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EASY BEACH LLC AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY INJURY, DEATH, OR PROPERTY DAMAGE, ARISING FROM OR RELATED TO THE SERVICE — INCLUDING MISSED, DELAYED, OR INACCURATE ALERTS — EVEN IF WE'VE BEEN ADVISED SUCH DAMAGES ARE POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS, COMBINED, IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE. NOTHING HERE LIMITS LIABILITY THAT THE LAW SAYS CANNOT BE LIMITED, INCLUDING FOR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT. IF ANY PART OF THIS LIMIT IS FOUND UNENFORCEABLE, OUR LIABILITY IS LIMITED TO THE SMALLEST AMOUNT THE LAW ALLOWS.

This section exists because Nearhold costs a few dollars a month and listens to public radio — it cannot stand behind outcomes the way an emergency service could, and we'd rather say that plainly than bury it.

The service can change

We can change, suspend, or discontinue the service or coverage of a county. If we discontinue service you've prepaid for, we'll refund the unused period. Payments run through Stripe and email through our delivery providers; their processing is subject to their own terms, and we're not responsible for their outages.

Disputes and governing law

These terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us at hello@nearhold.com and give us 30 days to work it out — most things a company this size gets wrong, it can fix quickly.

The fine print that keeps the rest standing

If a court finds part of these terms unenforceable, the rest stands. These terms plus the Privacy Policy are the entire agreement between us and replace anything else said anywhere — descriptions on our site and in our emails explain the service; the “no guarantees” section above always controls.

You can't transfer your founding spot, deposit, or account to someone else. We can assign these terms if Easy Beach LLC is acquired or reorganized — your founding rate survives that.

Changes to these terms

We'll update this page and the effective date above when anything changes. Material changes get announced by email at least 30 days before they take effect — and if you don't like a change, you can take your refund or cancel before it kicks in. That's always your right.
